- Direct Appeal of State or Federal Conviction The direct appeal is an opportunity to attack a conviction or sentence relying solely on information contained within the record of the trial or plea. Generally, a direct appeal must be filed within 30 days of the sentence. Our firm accepts cases in all federal circuits across the country and state cases throughout Ohio.
- State Post Conviction Relief If there were errors in the proceedings which occurred outside the record, a post conviction motion is the mechanism to obtain relief from a conviction and/or sentence. The post conviction relief statute allows you to add evidence to the record which was omitted from your trial or to bring newly discovered evidence before the Court to reverse a conviction or sentence. In Ohio, these motions generally must be filed within 180 days of when the transcript was filed in the direct appeal, except in the cases of newly discovered evidence.
- Federal Habeas Corpus Whenever a conviction has resulted in a sentence of incarceration in federal or state court there is an opportunity to have your case reviewed by the federal court.
- Supreme Court Appeals If a direct appeal, post conviction relief motion, habeas corpus motion or other post conviction motion is denied, the case can be appealed to the State Supreme Court and to the United States Supreme Court.
